VILLAGE OF MEDINA NOTICE OF REAL PROPERTY SALE Notice is hereby given by the Clerk of the Village of Medina, pursuant to a declaration of surplus properties resolved by the Board of Trustees of the Village of Medina on July 8, 2019, the Village of Medina will dispose of, at a public sale, by sealed bid, to the highest bidder, a certain parcel of surplus Village owned real property not needed for any municipal purposes. The sealed bids will be due by 12 noon on Monday, August 12, 2019, at the Village Clerk’s Office in the Village of Medina located at 119 Park Avenue, Medina, New York 14103, and, thereafter, at the Village Board meeting on Monday, August 12, 2019, at 7:00 p.m., said sealed bids shall be opened. The Village reserves the right to refuse all bids and/or re-bid said sale. Upon acceptance of the high bid, the successful high bidder shall be required to execute a Contract of Sale and make a cash sum or certified check (good faith) purchase money deposit in the amount of ten (10%) percent. Bids shall contain bidder’s name(s), address(es), phone number(s), email address(es) parcel address and SBL number, and proof of funds. The purchase money balance shall be due and payable at the Clerk of the Village of Medina when, at a time and date (approximately 30 days thereafter) specified on the Contract of Sale, a Quit Claim deed from the Village of Medina to the purchasers will be prepared and ready for delivery. The properties to be auctioned are as follows, designated by the following description: A portion of Bernz O Matic Drive, located within the Village of Medina and the Town of Shelby, beginning in the northwest corner of the intersection of the right-of-way of Bernz O Matic Drive with the Town border of Ridgeway and Shelby, and then heading south approximately 440 feet, then at a right angle westerly approximately 62 feet, then at a right angle northerly approximately 439 feet to the boundary between the Towns of Ridgeway and Shelby, then at an approximate 90 degree angle, 65 feet easterly to the point of beginning. Said parcel is approximately .6 acres and contains a section of Bernz O Matic Drive and its right-of-way surrounded on three (3) sides by property owned by B360 Holdings LLC. Subject to any necessary easements by the Village of Medina for any public utilities. Said premises hereinbefore described shall be sold (as is) in all respects, and shall be transferred without a search/abstract of title and survey. There shall be no title guarantee with regard to the property from the Village via Quit Claim deed. Purchaser shall take title of the premises subject to any existing liens, charges and exceptions to title on record. Purchaser shall be responsible for all recording costs. Final sale of this property shall be subject to the approval of the Board of Trustees of the Village of Medina.
